Genetic Guarantee *

The puppy is guaranteed (to be replaced by the breeder when a like animal is available) for two years from the date of purchase, against genetic defects. A veterinarian’s report must be supplied to the breeder within 72 hours of taking the puppy home for this guarantee to be honored and will be void unless these terms are met. Unless stated in writing by Divine Pups of an extension of wellness vet visit. If the puppy develops a genetic defect within the 2nd year limited guarantee it must be returned to the breeder. Under “No” circumstance is the puppy allowed to be destroyed prior to notification of the seller. All return shipping charges are the responsibility of the purchaser. The breeder however will pay shipping charges on a replacement puppy . All veterinarian charges incurred by the purchaser are the sole responsibility of the purchaser and will under no circumstances be paid by the breeder. If the puppy should die due to a Congenital or Hereditary defect within the 2 year period, the Seller will replace the puppy with another puppy at no cost to the buyer within a timely manner (8 months). The seller must receive proof in the form of a COMPLETE AUTOPSY REPORT completed by a licensed veterinarian and performed at the buyer’s expense stating cause of death. Seller is responsible for the shipping of the replacement puppy. The Buyer must give full access of all veterinary records of the aforementioned dog to Divine Pups in the event of a puppy being returned.

Not Included *

This warranty does not include viral illnesses, infections, improper bites, stress related illness, hernias, hypoglycemia, parasites (including Giardia or Coccidosis), cancer or endocrine disorders. It also does not include any illness due to the ingestion of foreign objects, food, chemicals or physical injury. G. No warranties or guarantees, expressed or implied, are made under this contract except as stated.

Vaccination & Deworming *

The seller will have completed all of the age appropriate vaccinations and deworming prior to the transfer of ownership. The seller will not warranty the puppy against any adverse reactions to future vaccinations , veterinarian visits or hospital stays due to airplane stress. Seller is not responsible for death or illness due to hypoglycemia (sugar drop). It is the responsibility of the buyer to ensure proper nutrition and care of the new puppy. Puppies are like children in that they are susceptible to pneumonia, colds and other infections due to drafts, cold temperatures, etc. Another problem is hypoglycemia (low blood sugar) that is brought on by a number of reasons including not eating properly, being handled too much, and the stress of being moved to a new home. I do not guarantee against any worms or coccidian parasites. These conditions are all the buyers responsibility.

Congenital Defect *

A congenital defect is a problem that will not allow the pup to grow to a normal life expectancy. A bone joint issue, luxating patella, going blind, being deaf, having a hernia, or having a limp is not considered life threatening. A major body organ that sustains life going bad (heart, lungs, liver, etc.) is considered a congenital defect and is covered for two years. Health problems that can be cured by medication or surgery are not covered.

Pet Quality *

Any estimated grown weight listed with a pup under 6 months old is only a best guess, not a guaranteed number. All puppies are sold as pets. No guarantee is made to disposition, conformation, size or breeding ability/quality.

Temperament *

1) Breeder cannot warranty the temperament of puppies. Both genetics and the environment in which the puppy is raised can affect temperament. We have no control over the environment in which a puppy is raised after leaving the Breeder’s home, therefore we cannot warranty temperament and no refunds will be given in the event the puppy is returned to the Breeder under this section. *
2) Breeder recommends Buyer attend a Puppy Kindergarten class or a Puppy Obedience class with their puppy.
3) If the vaccination status of the puppy prohibits participation in a public obedience class, the Breeder recommends seeking training from a private trainer to be done in the Buyer’s own home.
4) Buyer agrees to make all reasonable efforts to properly socialize the puppy.

Unconditional Lifetime Return Policy: *

If, at any time, for any reason, the Buyer finds that they are unable or unwilling to continue to care for this puppy the Buyer agrees to contact the Breeder FIRST. The Buyer is required to inform the Breeder of such an issue as soon as possible. 1) The Buyer understands and agrees that the puppy must be returned to the Breeder with no compensation to the Buyer. 2) If the Breeder, for whatever reason, is unable to take the puppy back, the Breeder must approve in writing the new home for any puppy sold by Breeder. Such permission shall not be withheld unreasonably, but Breeder has the exclusive right to determine the suitability of any potential subsequent owner. 3) Buyer agrees to either transport the puppy to the Breeder, or pay 50% of the shipping/transportation fees to Breeder’s location. 4) Buyer agrees that at the time of transfer of the puppy back to the Breeder all registration papers and medical records will be relinquished, and all necessary paperwork will be signed transferring ownership back to the Breeder. 5) If the dog has a permanent form of identification, such as a Microchip or Tattoo, the Buyer agrees to contact the agency that the dog is registered with and have the ownership/contact information for the dog transferred into the Breeder’s name. Buyer agrees to have this completed within 24 hours of when the puppy is back into the Breeder's care. 6) Buyer agrees that at no time will they, without prior written permission from the Breeder, sell, give, trade, lease, adopt, place, surrender or re-home this dog to any person, business or organization. 7) A penalty of three (3) times the total purchase price indicated on this document is owed by the Buyer to the Breeder in the event the puppy is transferred, in any way, without the prior written consent of the Breeder.

Re-Homing *

The buyer agrees to contact seller immediately if the buyer determines they are unable to keep their puppy for any reason. The buyer and seller will determine how the dog will be re-homed. The buyer agrees to never place their puppy with a rescue group, in a shelter, pound, or similar facility or research laboratory. The buyer certifies that they are not acting as an agent for another individual in the purchase of this puppy. The buyer commits to provide necessary vet checkups, vaccinations, worming, heart worm, weekly ear cleaning or as recommended by a licensed vet.

Pet Insurance

Trupanion *

Divine Pups Policy is that each puppy must have activated at least the 30-day coverage through Trupanion within 24 hours of receiving your puppy. Ongoing health insurance for at least the first 2 years (lifetime is preferable) is highly recommended. We believe that this is a part of responsible pet ownership. Divine Pups partners with Trupanion, which offers a complimentary 30-Day coverage at no cost to you. Policy premiums must be maintained by the pet owner regardless of the company chosen. Divine Pups strongly suggests doing your research and insuring your puppy with a reputable pet insurance company. All claims must be submitted to your pet insurance company prior to being submitted to Divine Pups

Media Release *

The buyer is allowing Divine Pups to use any pictures of the dog that you post on social media (including a minor child) to be used by Divine Pups in any manner they choose, generally by reposting and sharing on Facebook, Instagram, Twitter, You Tube, etc.... Pet Insurance

Preparation *

Buyer agrees to read Welcome Letter, Puppy Go Home Instructions and GET READY page on the website and follow instructions as listed.

Void Health Guarantee Terms *

The health guarantee of 2 years for any puppy will be void if the buyer vaccinates for Lepto. It is not the responsibility of the veterinarian but the buyer to ensure this non core vaccination is not given at any age.
In the event that a female conceives a litter prior to eighteen (18) months of age the Congenital/Hereditary Defect Warranty becomes null and void.
In the event that a male sires a litter of puppies prior to ten (10) months of age the Congenital/Hereditary Warranty becomes null and void.

Liability *

Buyer agrees to release and hold harmless the Breeder for any and all liability, damages or injuries caused either directly or indirectly by the puppy to any person, whether actual or legal, or to any property, whether real or personal. Furthermore, Buyer assumes full liability for any damages or injuries, whether physical, mental, emotional or economic, caused by the puppy to any person, whether real or personal, after receiving and acknowledging delivery and possession of said puppy. Buyer further agrees to indemnify or reimburse Breeder as a result of any costs or expenses incurred by the Breeder as a result of any act of Buyer causing liability damages or injuries as set forth herein.

Notifications *

1) If the Buyer moves from the address stated above, the Buyer shall, within 30 days of the address change, provide the new address and telephone number to Breeder. 2) If the Breeder moves from the address stated above, the Breeder shall, within 30 days of the address change, provide the new address and telephone number to the Buyer. 3) If the puppy develops any major medical condition the Buyer shall, within five (5) working days of diagnosis, notify the Breeder of the condition. 4) If the puppy becomes missing, lost or stolen, regardless of circumstances, Buyer must notify breeder within twenty-four (24) hours. We, as Breeders, have a very large network of friends and acquaintances that we can share the puppy’s information and last known location with to try to get the puppy home safely.

Full Breeding Rights Addendum *

1) Buyer agrees to purchase the puppy described above under the following warranties and conditions. NO OTHER WARRANTIES OR CONDITIONS ARE NEITHER EXPRESSED OR IMPLIED.
2) Both parties are 18 years of age or older and without any emotional or mental reservations whatsoever, are freely entering into this contract.
3) Contract/warranties are only implied between the Breeder and the original Buyer, NOT to a third party
4) Puppy is sold with FULL (Show/Breeding) Registration which allows the puppy to compete in conformation events and be bred at the appropriate age. a) Females are not to be bred prior to twelve (12) months, preferably eighteen (18) months, and after health screenings have been completed as recommended by the AKC Parent Breed Club b) Males are not to be bred prior to ten (10) months, preferably (12) months, and after all health screenings have been completed as recommended by the AKC Parent Breed Club c) All puppies must be bred with an acceptable registered partner (akc/ckc) that has been fully health tested
5) Puppy/dog is to be registered with American Kennel Club (AKC) and may NOT be registered by the Buyer with any other registry without prior written consent from the Breeder. Buyer cannot use Breeder’s kennel name in any puppy resulting from the puppy purchased.
6) Puppy cannot be used in the creation of a "new", "rare" or “designer” breed in any way shape or form.
7) Puppy is warranted only for the purpose of being a companion animal. While it may be capable of performing other functions, no warranty is given as to its fitness for any specific purpose.

Stipulations *

This contract must be signed at the time of delivery of puppy. Any legal action which may arise under the terms of this contract will be brought in Galveston County, Texas. The laws in the state of Texas shall be controlling. This guarantee is non-transferable. This guarantee is for original buyers only and cannot be transferred to secondary parties, and is only good for the length of time stated above. WE RESERVE THE RIGHT TO SELL OR NOT SELL TO ANY PERSON(S).
