A veterinarian’s report must be supplied to the breeder within 72 hours of taking the puppy home for this guarantee to be honored and will be void unless these terms are met. Unless stated in writing by Divine Pups of an extension of wellness vet visit. If the puppy develops a genetic defect within the 2nd year limited guarantee it must be returned to the breeder. Under “No” circumstance is the puppy allowed to be destroyed prior to notification of the seller. All return shipping charges are the responsibility of the purchaser. The breeder however will pay shipping charges on a replacement puppy . All veterinarian charges incurred by the purchaser are the sole responsibility of the purchaser and will under no circumstances be paid by the breeder. If the puppy should die due to a Congenital or Hereditary defect within the 2 year period, the Seller will replace the puppy with another puppy at no cost to the buyer within a timely manner (8 months). The seller must receive proof in the form of a COMPLETE AUTOPSY REPORT completed by a licensed veterinarian and performed at the buyer’s expense stating cause of death. Seller is responsible for the shipping of the replacement puppy. The Buyer must give full access of all veterinary records of the aforementioned dog to Divine Pups in the event of a puppy being returned.Not Included *This warranty does not include viral illnesses, infections, improper bites, stress related illness, hernias, hypoglycemia, parasites (including Giardia or Coccidosis), cancer or endocrine disorders. It also does not include any illness due to the ingestion of foreign objects, food, chemicals or physical injury. G. No warranties or guarantees, expressed or implied, are made under this contract except as stated.Vaccination & Deworming *The seller will have completed all of the age appropriate vaccinations and deworming prior to the transfer of ownership. The seller will not warranty the puppy against any adverse reactions to future vaccinations , veterinarian visits or hospital stays due to airplane stress. Seller is not responsible for death or illness due to hypoglycemia (sugar drop). It is the responsibility of the buyer to ensure proper nutrition and care of the new puppy. Puppies are like children in that they are susceptible to pneumonia, colds and other infections due to drafts, cold temperatures, etc. Another problem is hypoglycemia (low blood sugar) that is brought on by a number of reasons including not eating properly, being handled too much, and the stress of being moved to a new home. I do not guarantee against any worms or coccidian parasites. These conditions are all the buyers responsibility.Congenital Defect *A congenital defect is a problem that will not allow the pup to grow to a normal life expectancy. A bone joint issue, luxating patella, going blind, being deaf, having a hernia, or having a limp is not considered life threatening. A major body organ that sustains life going bad (heart, lungs, liver, etc.) is considered a congenital defect and is covered for two years. Health problems that can be cured by medication or surgery are not covered.Pet Quality *Any estimated grown weight listed with a pup under 6 months old is only a best guess, not a guaranteed number. All puppies are sold as pets. No guarantee is made to disposition, conformation, size or breeding ability/quality.Re-Homing *The buyer agrees to contact seller immediately if the buyer determines they are unable to keep their puppy for any reason. The buyer and seller will determine how the dog will be re-homed. The buyer agrees to never place their puppy with a rescue group, in a shelter, pound, or similar facility or research laboratory. The buyer certifies that they are not acting as an agent for another individual in the purchase of this puppy. The buyer commits to provide necessary vet checkups, vaccinations, worming, heart worm, weekly ear cleaning or as recommended by a licensed vet.Pet InsuranceTrupanion *Divine Pups Policy is that each puppy must have activated at least the 30-day coverage through Trupanion within 24 hours of receiving your puppy. Ongoing health insurance for at least the first 2 years (lifetime is preferable) is highly recommended. We believe that this is a part of responsible pet ownership. Divine Pups partners with Trupanion, which offers a complimentary 30-Day coverage at no cost to you. Policy premiums must be maintained by the pet owner regardless of the company chosen. Divine Pups strongly suggests doing your research and insuring your puppy with a reputable pet insurance company. All claims must be submitted to your pet insurance company prior to being submitted to Divine Pups Media Release *The buyer is allowing Divine Pups to use any pictures of the dog that you post on social media (including a minor child) to be used by Divine Pups in any manner they choose, generally by reposting and sharing on Facebook, Instagram, Twitter, You Tube, etc.... Pet InsuranceSpay/Neuter Part 1 *Permanent ownership of this dog is contingent upon the buyer’s compliance with this agreement. Proof of the spay/neuter must be received by Divine Pups via email info@yourdivinepup.com before the dog reaches the age of 10 months . In the event that the dog’s health does not allow this agreement to be honored, Divine Pups must be provided with a statement from your veterinarian that this dog is not in adequate physical condition for surgery. Based upon the veterinarian’s evaluation of this dog the buyer will contact the veterinarian and establish the earliest date that the procedure can be performed. The buyer will send proof of spay/neuter signed by the veterinarian attending the surgery within seven (7) days of the surgery completion. This is the responsibility of the buyer, not the veterinarian, to ensure that Divine Pups has received verification that the surgery has been performed. Failure to comply with this agreement, unless otherwise agreed to in writing, will be considered a breach of contract, and the buyer will transport this dog back to Divine Pups and will not be entitled to a refund. By my signature below, I agree to have this dog spayed/neutered by no later than 10 months of age and I understand that this spay/neuter agreement is an agreement that this dog WILL NOT produce a litter of puppies either as purposely bred or by accidental breeding. I also agree that should the dog not be altered that I will return said dog back to Divine Pups with no refund. The Buyer will be held liable for damages in the amount of $7,500 and any attorney fees if they are incurred, if the dog is bred accidentally, or purposefully. The Buyer agrees to pay the fine in full within 60 days of notification via text , email, or verbal communication. Payment will be made in the time frame by cash or Pay Pal to Divine Pups. If the Buyer fails to pay the fine within the set time frame, Divine Pups will seek Legal aid in recovering the damages. If it becomes necessary for Divine Pups to do so, the Buyer will pay all attorney and filing fees incurred to Divine Pups in attempt to recover the damages. These are the only payment arrangements agreed upon, no other arrangements are meant or implied unless in writing and agreed upon by Divine Pups.Spay/Neuter Part 2 *It is understood that at the time of sale that this said puppy is not to be used for breeding. It is a representation of its breed and it is structurally and temperamentally suited for a companion and/or working dog. It is being sold as a pet without breeding rightsSpay/Neuter Part 3 *If buyer has been requested to sign SPAYSECURE agreement, buyer must abide by all terms in SPAYSECURE agreement.Preparation *Buyer agrees to read Welcome Letter, Puppy Go Home Instructions and GET READY page on the website and follow instructions as listed.Void Health Guarantee Terms *The health guarantee of 2 years for any puppy will be void if the buyer vaccinates for Lepto. It is not the responsibility of the veterinarian but the buyer to ensure this non core vaccination is not given at any age. Void Health Guarantee Terms Part 2 *Spaying/neutering/gonad sparing surgery (GSS) by a licensed, reputable veterinarian is required on the above puppy at 10 months of age. A. Proof of this, in the form of a Certificate of Spay/Neuter from the Veterinarian, must be forwarded to seller by the time the puppy reaches 10 months of age. B. If seller does not receive this within this time, this contract will become null and void.Stipulations *This contract must be signed at the time of delivery of puppy. Any legal action which may arise under the terms of this contract will be brought in Galveston County, Texas. The laws in the state of Texas shall be controlling. This guarantee is non-transferable. This guarantee is for original buyers only and cannot be transferred to secondary parties, and is only good for the length of time stated above. WE RESERVE THE RIGHT TO SELL OR NOT SELL TO ANY PERSON(S).
